TERMS AND CONDITIONS
for the SUNMADE e-shop www.sunmade.cz
1. Introductory Provisions
These Terms and Conditions (hereinafter referred to as the “Terms”) govern the mutual rights and obligations between:

(hereinafter referred to as the “Seller”)
and
the Buyer, who concludes a purchase contract through the online store available at www.sunmade.cz (hereinafter referred to as the “E-shop”).
These Terms form an integral part of the purchase contract.
2. Definitions
Buyer – a natural or legal person entering into a purchase contract with the Seller.
Consumer – a natural person acting outside the scope of their business or professional activity.
Goods – products offered in the E-shop, in particular swimwear.
Order – a proposal to conclude a purchase contract submitted by the Buyer.
Purchase Contract – a contract concluded upon confirmation of the Order by the Seller.
3. Information About the Goods
3.1 The Goods are sold through the E-shop by means of distance selling.
3.2 Product photographs are for illustrative purposes only. Colour shades may slightly differ depending on the display settings of the device used.
3.3 Swimwear is considered hygienically sensitive goods, similarly to underwear.
3.4 Size charts are provided as a general guide. Minor size deviations do not constitute a defect.
4. Order and Conclusion of the Purchase Contract
4.1 The Buyer places an Order via the E-shop.
4.2 The Purchase Contract is concluded at the moment the Seller confirms the Order by email.
4.3 The Seller reserves the right to refuse an Order, in particular in cases of:

stock depletion,
-
an obvious pricing error,
-
suspicion of system misuse.
5. Price and Payment Terms
5.1 All prices are stated in CZK and are final, including VAT, unless stated otherwise.
5.2 The Buyer may pay the purchase price using the payment methods available in the E-shop (e.g., payment card, bank transfer).
5.3 The tax document (invoice) is sent electronically to the Buyer.
6. Delivery Terms
6.1 Goods are delivered via carriers specified in the E-shop.
6.2 Delivery times are indicative and depend on the selected delivery method.
6.3 The risk of damage to the Goods passes to the Buyer upon receipt of the shipment.
7. Withdrawal from the Contract
7.1 General Right of Withdrawal
A Consumer has the right to withdraw from the contract within 14 days of receiving the Goods, unless otherwise provided by law.
7.2 Exceptions to the Right of Withdrawal
Pursuant to Section 1837(g) of the Czech Civil Code, withdrawal from the contract is not permitted in respect of goods which, for hygiene reasons, were fitted with a protective element and where that protective element has been broken after delivery.
The swimwear sold is fitted with a hygiene seal (a protective sticker located in the crotch area).
If this hygiene seal is broken, removed, or otherwise damaged, the Buyer’s right to withdraw from the contract shall cease.
8. Hygiene Seal
8.1 The hygiene seal is a protective element placed in the crotch area of the swimwear.
8.2 It serves to protect the health and hygiene of customers.
8.3 If the hygiene seal is broken or removed, the swimwear is considered used goods.
8.4 Goods with a broken hygiene seal cannot be returned or exchanged.
9. Complaints and Liability for Defects
9.1 The Buyer is entitled to claim manufacturing defects in the Goods.
9.2 The following do not constitute defects:

incorrect size selection,

normal wear and tear,
-
damage resulting from improper use or care,

a broken hygiene seal.
9.3 Complaints must be submitted by email to obchod@sunmade.cz.
9.4 Complaints will be processed no later than 30 days from the date of submission.
10. Personal Data Protection
10.1 The Seller processes personal data in accordance with applicable legal regulations.
10.2 Detailed information is provided in a separate Privacy Policy document.
11. Out-of-Court Dispute Resolution
11.1 A Consumer has the right to out-of-court dispute resolution through:

12. Final Provisions
12.1 These Terms and Conditions are effective as of 1 March 2026.
12.2 The Seller reserves the right to amend these Terms.
12.3 Legal relationships are governed by the laws of the Czech Republic.
